TERMS OF SERVICE

Please read these Terms of Service ("Terms," "Terms of Service," or "Agreement") carefully before downloading, installing, accessing, or using mobile games and services developed and published by Jagdish Sahu, operating as SAHU GAMES ("SAHU GAMES," "we," "us," or "our"), including all mobile games and services published by SAHU GAMES (including titles listed in the Supported Games Matrix in Section 2, collectively the "Games" or "Services").

By downloading, installing, accessing, or using any of our Games, you ("you," "your," or "User") agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, access, or use the Games.

1.1 By downloading, installing, accessing, or using the Games, you represent and warrant that:

• (a) You are at least 13 years of age;
• (b) If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you have obtained your parent's or legal guardian's permission to use the Games and they have agreed to these Terms on your behalf;
• (c) You have the legal capacity to enter into a binding legal agreement;
• (d) You will comply with these Terms and all applicable local, national, and international laws and regulations.

1.2 If you are a parent or legal guardian agreeing to these Terms on behalf of a minor, you are fully responsible for the minor's use of the Games, including all financial charges and legal liabilities.

SAHU GAMES develops and publishes high-quality indie mobile titles. The specific features, licensing, monetization methods, and store availability for each title are set forth in the modular matrix below:

Core features across our Games may include:

• (a) Single-player arcade and puzzle game mechanics;
• (b) Optional in-app purchases of virtual items and currency;
• (c) Advertisements served by certified advertising networks;
• (d) Local, offline leaderboards and achievements;
• (e) Player customization options (outfits, themes, trails);
• (f) Offline gameplay capability without requiring continuous internet connectivity.

Subject to your continuous compliance with these Terms, SAHU GAMES grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Games on a compatible mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

You agree that you will NOT:

• (a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Games;
• (b) Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices;
• (c) Use the Games for commercial purposes or the benefit of third parties without written authorization;
• (d) Distribute, sublicense, lease, rent, lend, or transfer the Games or APK binaries;
• (e) Use the Games in any manner that could damage, disable, overburden, or impair game operations;
• (f) Deploy unauthorized third-party software, bots, memory editors, or trainers ("cheats" or "mods");
• (g) Exploit software glitches, bugs, or design oversights for unfair personal advantage;
• (h) Use the Games in violation of applicable laws or regulations;
• (i) Attempt to gain unauthorized access to SDKs, telemetries, or associated systems;
• (j) Use the Games in any manner not expressly authorized by these Terms.

All rights not expressly granted to you in these Terms are reserved by SAHU GAMES. The Games are licensed, not sold, to you.

The Games, including all code, artwork, audio clips, animations, visual effects, visual design, user interfaces, music, game mechanics, and the selection and arrangement thereof, are owned by Jagdish Sahu / SAHU GAMES and are protected by international copyright, trademark, and intellectual property laws.

"SAHU GAMES," our game titles (including all titles identified in Section 2), and all associated logos, branding, and trade dress are trademarks of Jagdish Sahu / SAHU GAMES. You are not permitted to use these trademarks without prior written consent.

Any username or player avatar you choose within the Games remains your content. By creating such content, you grant SAHU GAMES a worldwide, royalty-free license to display and store such content locally for operating the Game.

If you submit suggestions, ideas, or bug reports ("Feedback"), you grant SAHU GAMES an irrevocable, perpetual, royalty-free, worldwide license to use, adapt, and incorporate such Feedback into our Games without compensation or obligation to you.

Our Games may offer virtual currency, cosmetic items, and bundles for purchase ("In-App Purchases"). All purchases are processed through Google Play Billing and are subject to Google Play's terms and conditions.

All In-App Purchases are:

• (a) Final and non-refundable, except as required by applicable law or Google Play's refund policies;
• (b) Consumable or non-consumable as described at point of sale;
• (c) Licensed to you, not sold, conveying no proprietary ownership;
• (d) Valid only within the specific Game purchased and possessing no real-world monetary value.

Virtual items and currencies (such as Coins and Gems) are digital game assets. You acknowledge that they cannot be exchanged for real money or goods from SAHU GAMES or third parties. We reserve the right to rebalance, manage, modify, or eliminate virtual items at our sole discretion. Selling or trading virtual currency outside the Game is strictly prohibited.

Prices for In-App Purchases are displayed in your local currency by the Google Play Store. We reserve the right to adjust pricing at any time. Price changes do not retroactively apply to completed purchases.

Refund requests for In-App Purchases must be submitted directly to Google Play in accordance with their consumer policies. SAHU GAMES does not process payments or issue monetary refunds directly.

You are responsible for all In-App Purchases initiated on your device. We encourage parents and guardians to configure device-level password or biometric authentication to prevent accidental or unauthorized purchases by minors.

Supported free versions of our Games display advertisements served by Google AdMob and certified mediation partners (including Meta Audience Network and Unity Ads). By playing our Games, you agree that ads may be shown during gameplay.

Personalized advertisements are displayed only with your consent, collected via the Google User Messaging Platform (UMP) consent dialog. You can change your advertising preferences at any time via the in-game Settings menu or your Android ad settings.

If you decline personalized advertising consent, you will still receive non-personalized, contextual advertisements.

SAHU GAMES does not endorse and is not responsible for products or services offered by third-party advertisers. Interactions with advertisers are solely at your own risk.

You agree to use our Games lawfully and responsibly. You shall not:

• (a) Engage in illegal, harassing, threatening, or abusive behavior;
• (b) Choose offensive, vulgar, or discriminatory player display names;
• (c) Use automated tools, bots, scrapers, or memory injectors;
• (d) Interfere with game operations or third-party connections;
• (e) Exploit code flaws or redistribute cracked application files.

All game progression, scores, achievements, currency balances, and unlocked customizations are stored locally on your device using AES-256 encryption. SAHU GAMES maintains no external cloud backup of your individual game save data.

You are solely responsible for maintaining the integrity of your device and data. We are not liable for data loss caused by device damage, uninstallation, operating system updates, or clearing application storage.

You may voluntarily delete all locally stored game data at any time via the "Delete Game Data" option in the in-game Settings menu. This action is instantaneous and irreversible.

We reserve the right to update, modify, suspend, or discontinue any Game (or feature) at any time. Updates may introduce balance changes, bug fixes, or new features. Certain updates may be required for continued play. The Games are provided on an "AS IS" and "AS AVAILABLE" basis.

Your privacy is governed by our Privacy Policy, available at https://sahugames.com/pp.html and within the Games. By using our Games, you acknowledge that you have read and understood our Privacy Policy, including the game-specific data collection matrix.

The Games integrate third-party services, including Google AdMob, Google Play Billing, GameAnalytics, Meta SDK, and VoxelBusters. Your use of third-party services is subject to their respective terms and privacy policies.

THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL DEVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAHU GAMES, JAGDISH SAHU, OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR VIRTUAL CURRENCY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS (USD $50.00), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless SAHU GAMES, Jagdish Sahu, and our affiliates from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Games or violation of these Terms.

You may terminate these Terms at any time by uninstalling the Games. We may suspend or terminate your license immediately if you violate these Terms. Upon termination, all licenses immediately cease.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Mandatory consumer protections in your country of residence remain unaffected.

Before filing any legal action, you agree to contact us at [email protected] to attempt an informal resolution within thirty (30) days.

If informal resolution is unsuccessful, any dispute shall be submitted to the exclusive jurisdiction of the competent courts located in Chhattisgarh, India.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SAHU GAMES regarding our Games.

If any provision of these Terms is held invalid or unenforceable, that provision will be severed, leaving all remaining provisions in full force and effect.

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

You may not assign these Terms. SAHU GAMES may freely assign its rights and obligations.

We shall not be liable for failures or delays resulting from causes beyond reasonable control, including natural disasters, internet disruptions, pandemics, strikes, or governmental actions.
